Welcome to Straps & Strides (referred to as “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and related services (collectively, the “Platform”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

 

 

1. Definitions

“Customer” or “You” means any individual or entity accessing the Platform.

“Products” refers to all goods listed for sale on the Platform.

“Order” means a request to purchase Products submitted through the Platform.

“Naira” or “NGN” refers to the official currency of the Federal Republic of Nigeria.

“Applicable Law” means all applicable Nigerian statutes, regulations, and guidelines including the Consumer Protection Framework Act (CPFA), the Federal Competition and Consumer Protection Act (FCCPA) 2018, the Cybercrimes (Prohibition, Prevention, etc.) Act 2015, and any other relevant legislation.

 

 

2. Eligibility

To use this Platform and place orders, you must:

  • Be at least 18 years of age, or have the consent of a parent or legal guardian;
  • Have the legal capacity to enter into binding contracts under Nigerian law;
  • Provide accurate and complete registration information;
  • Not be barred from using e-commerce services under Applicable Law.

 

By using the Platform, you represent and warrant that you meet all eligibility requirements.

 

 

3. Account Registration

You may be required to create an account to access certain features of the Platform. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain the security and confidentiality of your login credentials;
  • Notify us immediately at hello@strapsandstrides.com of any unauthorised access to your account;
  • Accept responsibility for all activities conducted under your account.

 

We reserve the right to suspend or terminate accounts that violate these Terms or Applicable Law.

 

 

4. Products and Listings

We make every effort to display Products accurately on our Platform. However, we do not warrant that product descriptions, images, pricing, or availability are error-free. We reserve the right to:

  • Correct any errors, inaccuracies, or omissions at any time;
  • Refuse or cancel any Order where an error has occurred, including pricing errors;
  • Limit quantities of Products purchased per customer or per Order.

 

Product availability is subject to change without notice. We shall not be liable for any loss arising from your reliance on inaccurate product information.

 

 

5. Orders and Contract Formation

Placing an Order on the Platform constitutes an offer to purchase. A binding contract is only formed when we send an Order Confirmation email to your registered email address.

 

We reserve the right to reject or cancel any Order at our discretion, including where:

  • Payment is declined or fraudulent activity is suspected;
  • Products are out of stock or discontinued;
  • There is an error in the product listing or pricing;
  • The Order violates these Terms or Applicable Law.

 

In the event of cancellation after payment, we will issue a full refund within 7 (seven) business days.

 

 

6. Pricing and Payment

6.1 Pricing

All prices are quoted in Nigerian Naira (NGN) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without prior notice.

 

6.2 Payment Methods

We accept the following payment methods:

  • Bank transfers and USSD payments;
  • Debit and credit cards (Visa, Mastercard, Verve);
  • Mobile payment platforms (e.g., Flutterwave, Paystack, OPay);
  • Such other methods as we may introduce from time to time.

 

6.3 Payment Security

All transactions are processed through secure, third-party payment gateways. We do not store your financial information. Payment disputes should be directed to your bank or payment provider as well as our support team.

 

 

7. Delivery and Shipping

We deliver to locations within Nigeria. Delivery timelines and fees are displayed at checkout and vary based on your location and the shipping method selected.

 

We are not liable for delays caused by:

  • Force majeure events (floods, strikes, civil unrest, etc.);
  • Incorrect or incomplete delivery information provided by you;
  • Actions of third-party logistics providers.

 

Title and risk of loss for Products pass to you upon delivery. Please inspect your order upon receipt and notify us of any discrepancies within 48 hours.

 

 

8. Returns, Refunds, and Exchanges

We are committed to customer satisfaction in accordance with the Federal Competition and Consumer Protection Act (FCCPA) 2018.

 

8.1 Returns

You may return a Product within 24 hours of delivery if:

  • The Product is defective, damaged, or materially different from what was ordered;
  • The Product is in its original packaging and unused condition.

 

8.2 Non-Returnable Items

The following items are not eligible for return:

  • Fine Jewellery & watches;
  • Bespoke/Custom orders;
  • Sale & Discounted Items;
  • Perfume & Beauty Items.

 

8.3 Refunds

We do not offer cash refunds. All approved resolutions will be in the form of an exchange or store credit note only. The form of resolution is at the discretion of straps & strides management.

 

 

9. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Straps & Strides or its licensors and is protected under Nigerian copyright law and applicable international treaties.

 

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, or create derivative works from any content;
  • Use our trademarks or branding without prior written consent;
  • Reverse-engineer or attempt to extract source code from the Platform.

 

 

10. Prohibited Conduct

You agree not to use the Platform to:

  • Violate any Applicable Law or regulation;
  • Engage in fraudulent, deceptive, or misleading conduct;
  • Upload or transmit malware, viruses, or malicious code;
  • Infringe upon the intellectual property rights of any party;
  • Harass, abuse, or harm other users or our staff;
  • Conduct unauthorised data scraping or automated queries;
  • Engage in any activity that disrupts or damages the Platform.

 

Violation of this section may result in immediate suspension or termination of your account and may be reported to appropriate Nigerian law enforcement authorities.

 

 

11. Data Privacy and Protection

We are committed to protecting your personal data in accordance with the Nigeria Data Protection Act 2023 (NDPA) and the Nigeria Data Protection Regulation (NDPR).

 

By using the Platform, you consent to the collection, processing, and use of your personal data as described in our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy is available at www.strapsandstrides.com/privacy-policy.

 

We implement appropriate technical and organisational measures to safeguard your data against unauthorised access, loss, or disclosure.

 

 

12. Limitation of Liability

To the fullest extent permitted by Nigerian law, we shall not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of the Platform;
  • Loss of profits, data, goodwill, or business opportunities;
  • Damages resulting from third-party actions or services;
  • Service interruptions, technical errors, or Platform downtime.

 

Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid for the specific Product or service giving rise to the claim.

 

 

13. Disclaimers

The Platform and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, to the extent permitted by law. We do not warrant that the Platform will be uninterrupted, secure, or free from errors.

 

 

14. Third-Party Links and Services

The Platform may contain links to third-party websites or services. These links are provided for your convenience only. We do not endorse, control, or take responsibility for the content or practices of any third-party site. Your interactions with third-party services are governed by their respective terms and privacy policies.

 

 

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

 

15.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or in connection with these Terms, the parties shall first attempt to resolve the matter amicably through negotiation within 30 (thirty) days of written notice.

 

If the dispute is not resolved through negotiation, either party may refer the matter to mediation under the Lagos Multi-Door Courthouse (LMDC) or any mutually agreed alternative dispute resolution body.

 

If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of [State, e.g., Lagos State] Nigeria.

 

 

16. Consumer Rights

Nothing in these Terms limits or excludes rights granted to consumers under the Federal Competition and Consumer Protection Act (FCCPA) 2018 and other Applicable Law. You are entitled to:

  • Safe and quality products;
  • Accurate product information;
  • Redress for defective goods or services;
  • Fair and honest dealing.

17. Amendments to These Terms

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

 

 

19. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Straps & Strides with respect to your use of the Platform and supersede all prior agreements.
